These Terms and Conditions (the "Terms") are provided by 1Drive TMS ("1Drive TMS", "we", "our", or "us"). 1Drive TMS is the business and registered brand name for this service. These Terms govern access to and use of https://www.1drivetms.com, the 1Drive TMS web dashboard, the 1Drive TMS mobile application, and the 1Drive TMS transactional SMS program.

1. Agreement to These Terms

By creating an account, accessing, or using 1Drive TMS, you agree to these Terms and the 1Drive TMS Privacy Policy at https://www.1drivetms.com/privacy-policy.html. If you do not agree, do not use the service. If you use 1Drive TMS on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.

2. Description of the Service

1Drive TMS is a transportation management platform for registered drivers and administrators. The service may include trip assignment, scheduling, clock-in/out, attendance, dispatch, GPS tracking during work hours, inspections, payroll-related records, and related operational tools. Features may change over time.

3. Accounts and Eligibility

You must be at least 18 years old to use 1Drive TMS.
You must provide accurate account information, including a valid phone number if you opt in to SMS notifications.
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
Notify us promptly at support@1drivetms.com if you believe your account has been compromised.

4. SMS Messaging Terms

1Drive TMS SMS Alerts Program — transactional notifications for trip assignments, schedule updates, clock-in/out confirmations, attendance alerts, dispatch notifications, and other service-related operational messages for registered drivers and administrators who opt in.

Consent

Consent for messaging is not a requirement for service. Opt-in is website / web form only. During account signup, the SMS consent checkbox is displayed unchecked by default. You must actively check the checkbox to subscribe. The SMS consent checkbox is separate from acceptance of these Terms and Conditions and the Privacy Policy and is not pre-selected. Users who do not check the box are not subscribed to SMS notifications. Consent is not a condition of purchasing or using 1Drive TMS. There are no keyword-based opt-in commands. Opt-Out

You can cancel the SMS service at any time. Just text STOP to the number from which you received messages. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from 1Drive TMS. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

5. Acceptable Use

You agree not to:

Misrepresent your identity or the information you submit through the platform.

6. Fees

Organization accounts may be subject to subscription or usage fees described at the time of purchase or in a separate order. You are responsible for applicable taxes. Message and data rates charged by your wireless carrier for SMS are separate from 1Drive TMS fees.

7. Intellectual Property

The 1Drive TMS platform, including its software, branding, and content, is owned by 1Drive TMS or its licensors. The name "1Drive TMS" and related logos are trademarks of 1Drive TMS. You receive a limited, non-exclusive, non-transferable license to use the service during your subscription. You retain rights to data you submit. You grant us a license to host and process that data as needed to provide the service.

8. Disclaimers

The service is provided on an "as is" and "as available" basis. We do not warrant that 1Drive TMS will be uninterrupted, error-free, or that SMS messages will be delivered without delay. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, 1Drive TMS and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the service or from delayed or undelivered SMS messages. Our total liability for claims relating to the service will not exceed the amount you paid us for the service in the twelve months before the claim.

10. Termination

You may stop using 1Drive TMS at any time. We may suspend or terminate access if you violate these terms or if needed to protect the service or other users. After termination, provisions that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will remain in effect. SMS opt-out remains available by replying STOP while the messaging program is active.

11. Changes to These Terms

We may update these Terms and Conditions from time to time. We will post the revised terms on this page and update the "Last updated" date. Material changes may also be communicated by email or through the app. Continued use of 1Drive TMS after the changes take effect constitutes acceptance of the updated terms.
